**What documentation do I need for the R&D tax credit, and can I claim a past year?** The records a credit stands on, what an amended-return claim must contain, which elections it can't make, and where state credits come in.

A research credit is a claim, and the claim is the records. The regulation says it plainly.

> “A taxpayer claiming a credit under section 41 must retain records in sufficiently usable form and detail to substantiate that the expenditures claimed are eligible for the credit.”

— [Treas. Reg. §1.41-4(d)](https://www.law.cornell.edu/cfr/text/26/1.41-4), Recordkeeping for the research credit

| Record | Why |
| --- | --- |
| The uncertainty at the start, and the alternatives tried | It's the process of experimentation, in the engineers' own words |
| Tests and their results | Evidence the alternatives were evaluated |
| Time by person and business component, each month | It sets each person's share of wages |
| Payroll registers that tie to the books | Wages are most of the claim |
| Contracts with research firms | Signed before the work, at your risk, results yours |
| Where each person and contractor works | Foreign research is excluded from the credit |
| Invoices for supplies used up in the research | Supplies are a QRE only if consumed in it |

What to keep, during the year, for each business component.

Hypothetical: StockMatch's research log, written as the work happened.

**Kept as the work happens**
- Pro: Describes what was actually uncertain
- Pro: Ties to payroll month by month
- Pro: Ready for Section G
- Con: Ten minutes a week from people who'd rather be building
- Best for: Every company that means to claim

**Reconstructed at year end**
- Pro: No effort during the year
- Con: Memory fills the gaps
- Con: Time shares become estimates
- Con: Harder to defend when asked
- Best for: Nobody, by choice

Records kept during the year, or rebuilt after it.

## Claiming a year you missed

An income tax credit for an earlier year can be claimed on an amended return, but the claim has to arrive complete. The IRS lists what makes it valid: every business component the claim relates to; for each, the research activities, who did them (names or titles) and what each was trying to discover; and the total qualified wages, supplies and contract research for the year. On Form 6765 that's Section G with column 49(f).

> “Specifically, for a claim for refund that includes an IRC Section 41 research credit to be considered a valid claim, taxpayers are required to provide the following items of information at the time the claim for refund is filed with the IRS”

— [IRS, Required information for a valid research credit claim for refund](https://www.irs.gov/businesses/required-information-for-a-valid-research-credit-claim-for-refund), What an amended-return research credit claim must contain

| Election or claim | On an amended return? |
| --- | --- |
| The research credit itself | Yes, with the required information, inside the refund window |
| The alternative simplified credit | Only for a year that never claimed the credit |
| The payroll election | No: only on a timely filed original return |
| The §280C reduced credit | No: made or changed only on the original timely return |

What an amended return can and can't do.

> “An ASC election can be made on an amended return for a tax year only if you hadn’t previously claimed the research credit on an original return or amended return for that tax year.”

— [Instructions for Form 6765 (Rev. December 2025), Section B](https://www.irs.gov/pub/irs-pdf/i6765.pdf) (PDF), Electing the alternative simplified credit

## State research credits

States can have research credits of their own, with their own rules. California's is one: based on the federal credit with modifications, for research done in California, with its own version of the ASC from 2025.

> “For California purposes the ASC is equal to 3% of qualified research expenses (QREs) that exceed 50% of the average QREs for the three preceding taxable years.”

— [California Franchise Tax Board, California research credit](https://www.ftb.ca.gov/file/business/credits/california-research.html), California's research credit, conformed to the ASC from 2025

> **Check your state.** Whether a state has a research credit, what it's worth and how it follows the federal rules is state law. Read the state revenue department's own page before counting on one.

> **Write down the uncertainty, the alternatives and the time while the work is happening. Every later step, from Section G to an IRS question, reads from it.**
