Incentives run through AEDC
Arkansas’s research and investment incentives are administered by the Arkansas Economic Development Commission rather than claimed directly on the return. They generally require an application and a certification before the spending or the investment, so a startup should approach AEDC early — ideally before signing a lease or a research agreement in the state.
Expiring losses change the math
With a 10-year NOL carryforward and no bonus depreciation, Arkansas is a state where early losses can expire unused. A company planning a long build before profit should model whether its Arkansas losses survive until it has Arkansas income — and whether the timing of large capital purchases makes a difference to that.
Act 719’s move to market-based sourcing also changes the picture for companies with Arkansas customers but no Arkansas staff, especially if they sell to the large Northwest Arkansas retail and logistics companies headquartered there.
Where founders go wrong in Arkansas
Arkansas’s quirks are mostly in its differences from federal rules rather than in its rates.
- Forgetting the franchise tax report on May 1 — it goes to the Secretary of State, not DFA.
- Carrying federal bonus depreciation into the Arkansas return.
- Treating Arkansas NOLs as indefinite.
- Skipping the unclaimed property report — Arkansas requires a negative report even when there is nothing to remit.
- Paying the federal $7.25 when Arkansas’s minimum wage is $11.00.

Common questions
Does Arkansas have an R&D credit for startups?
Arkansas research incentives are administered by the Arkansas Economic Development Commission, which certifies the project or the business before the credit can be claimed. They are not a line a company computes on its return alone, so the time to ask is before the research spending, not at year end.
How does Arkansas tax a founder’s exit?
Arkansas has its own capital gains rules for individuals, published by DFA, and its individual rates top out at 3.7% in the 2026 withholding formula. Whether a federal QSBS exclusion carries over depends on how Arkansas computes the gain; check DFA’s capital gains guidance for the year of sale.
Advisory next door
- MOMissouri advisoryMissouri’s research credit is capped and allocated by the Department of Economic Development. Since 2025, individuals pay no Missouri tax on capital gains.
- TNTennessee advisoryTennessee has no tax on wages and a lighter franchise tax since 2024, but entities still pay franchise, excise and gross-receipts business tax, and SaaS is subject to sales tax.
- MSMississippi advisoryMississippi is cutting its individual rate to 4.0% in 2026 and 3.0% by 2030, repealing its franchise tax from 2028, and since 2023 exempting SaaS hosted outside the state; its quirks are throwback and its own 1099 threshold.
- LALouisiana advisoryLouisiana’s R&D credit is worth up to 30% of in-state research spending above a base amount, but LED certifies it first and claims share a $12 million statewide cap each fiscal year. The 2025 reform is the backdrop for every other decision.
- TXTexas advisoryFrom 2026 Texas has a new R&D credit, refundable to companies under the no-tax-due threshold. With no personal income tax, QSBS and PTE elections are federal questions.
- OKOklahoma advisoryOklahoma’s incentives are targeted programs rather than a broad R&D credit, and its three-factor formula makes office location a corporate tax decision.
