Falling rates
West Virginia has cut its personal income tax repeatedly. For tax years beginning in 2026 the rates run from 2.11% on the first $10,000 of taxable income to 4.58% above $60,000. A separate statute provides for further reductions when revenue conditions are met. For founders and employees living in West Virginia, that is one of the lower top rates among neighboring states.
The unemployment side is moving the same way: from July 1, 2026 the statute reduces each employer’s otherwise applicable contribution rate by 7%.
The R&D credit
West Virginia’s strategic research and development credit is the greater of 3% of the company’s annual qualified R&D expenditure or 10% of the excess over a base amount. It is a certification program: the company files a written research plan with the Tax Commissioner, and a missed application forfeits the year’s credit entirely. Unused credit carries forward.
For a startup with research staff in West Virginia, the 3% option is the floor: a company spending $1 million a year on qualifying West Virginia research could claim at least $30,000, without needing a growing base.
Where founders go wrong
West Virginia’s state rules are straightforward; the mistakes are in short deadlines and in its broad taxation of services.
- Reporting new hires on the federal 20-day schedule instead of West Virginia’s 14 days.
- Not reporting contractors paid $2,500 or more as new hires.
- Missing the June 30 annual report and $25 fee.
- Assuming SaaS is exempt without checking whether it is data processing.
- Overlooking city business and occupation taxes on gross receipts.

Common questions
Is there a West Virginia R&D credit?
Only with planning. West Virginia’s strategic research and development credit is the greater of 3% of the year’s qualified R&D expenditure or 10% of the excess over a base amount, but the program must be certified by the Tax Commissioner, and a late application forfeits the credit. Unused credit carries forward.
What is West Virginia’s income tax rate now?
It has been falling. For tax years beginning in 2026 the rates run from 2.11% to 4.58% on income over $60,000, after several years of statutory cuts. Withholding tables follow the statute.
Advisory next door
- KYKentucky advisoryKentucky’s state rates are moderate, but local occupational license taxes on wages and profits, a sales tax that reaches SaaS and a $175 minimum LLET catch startups, and 2026 conformity skips Section 174A.
- MDMaryland advisoryMaryland’s R&D credit is 10% over a base and refundable for small businesses. Biotech investors get a refundable credit, and FAMLI adds a payroll cost from January 2027.
- OHOhio advisoryOhio’s 7% R&D credit offsets only the CAT, which most startups no longer owe; the advice that matters is about cities, remote hires and the state-run workers’ comp fund.
- PAPennsylvania advisoryPennsylvania’s R&D credit can be sold, which makes it worth applying for before profit. Pennsylvania doesn’t follow federal QSBS, and its corporate rate keeps falling to 4.99% in 2031.
- VAVirginia advisoryVirginia’s R&D credit is refundable but small and capped. The bigger planning items are scheduled minimum wage increases through 2028 and a new paid family leave program collecting from April 2028.
